Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Nicky Golf (the “Service”), operated by Nicky Golf (“Nicky Golf,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Service. By using the Service you represent that you meet this requirement and that the information you provide is accurate.

Beta service

The Service is currently offered as a private beta. It is provided on an “as is” and “as available” basis, is under active development, and may change, be interrupted, or be discontinued at any time. Features may be incomplete, and data may occasionally be lost. Please do not rely on the Service as your sole record of your golf information.

Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at nicky@nickygolf.com if you suspect unauthorized use.

Your content and data

You retain ownership of the golf data, messages, and other content you submit (“Your Content”). You grant Nicky Golf a worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate and improve the Service and to generate analysis and recommendations for you, including by sending it to the AI and infrastructure providers described in our Privacy Policy. You are responsible for ensuring you have the right to share any content you submit.

AI-generated output and not advice

Nicky Golf uses artificial intelligence to produce debriefs, practice plans, and recommendations. This output may contain errors, omissions, or inaccuracies and is provided for general informational purposes only. It is not professional golf instruction, medical, fitness, or other professional advice. Use your own judgment and consult a qualified professional where appropriate. You assume responsibility for decisions you make based on the Service.

Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems;
• scrape, harvest, or bulk-extract data from the Service except as expressly permitted;
• upload malicious code or content that infringes others’ rights; or
• misrepresent your identity or impersonate others.

Intellectual property

The Service — including its software, design, branding, and the “Nicky” name and persona — is owned by Nicky Golf and protected by intellectual-property laws. Except for Your Content, these Terms do not grant you any rights to our intellectual property.

Third-party services

The Service relies on and may link to third-party services (such as those listed in our Privacy Policy). We are not responsible for the content, policies, or practices of third parties.

Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analysis will be accurate or lead to improved performance.

Limitation of liability

To the fullest extent permitted by law, Nicky Golf and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. You may request deletion of your account by emailing nicky@nickygolf.com.

Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in North Carolina for any dispute not subject to arbitration or small-claims resolution.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
